Print Sales & Refund Policy

All prints are custom-produced.

Due to the custom nature of photographic products, all sales are considered final.

If a product arrives damaged, customers must notify Shutter & Motion Photography LLC within one (1) days of delivery and provide photographs of the damage. All packages, crates, and envelopes if used must be inspected before opening, all noticable damamges must be documented prior to opening package. Once package is opening, customer must inspect print order for damamge that has exceeeded the packaging and document it. 

Claims are to be taken and investigated by Shutter & Motion Photography.LLC only. Approved claims may qualify for replacement at no additional charge.

Shutter & Motion Photography.LLC reserves the right to approve or deny all damage claims. 

Shipping delays caused by carriers are outside the control of Shutter & Motion Photography LLC.

Event Photography Notice

Shutter & Motion Photography LLC regularly photographs public events, motorsports competitions, automotive gatherings, community events, and similar activities.

Photographs captured during public events may be displayed on:

• This website

• Social media platforms

• Marketing materials

• Promotional publications

• Portfolio galleries

Attendance at public events may result in incidental appearance within photographs.

4. Collector's Edition Fine Art Prints

Certain photographs offered by Shutter & Motion Photography LLC are designated as Collector's Edition Fine Art Prints.

These works represent the highest level of quality offered by the studio and are produced in strictly limited quantities to preserve their exclusivity and collectible nature.

Edition Limits

Each Collector's Edition image is produced in a limited quantity. Once an edition reaches its stated limit, no additional Collector's Edition prints of that image will be produced.

The edition size for each image will be clearly identified at the time of purchase.

Once the limit has been reached there will be no re-print, next edition print, anniversary print, these print options will be retired and will not be featured in other collector's edition options, open print options or digital. Original files will be remanded to archival storage. 

Certificate of Authenticity

Each Collector's Edition print includes a Certificate of Authenticity containing:

• Image title

• Edition number

• Edition size

• Photographer signature

• Date of issue

Premium Materials

Collector's Edition prints are produced using archival-quality materials selected for long-term preservation, color accuracy, and display quality.

Specifications may vary by image and will be disclosed within the product description.

Copyright

Ownership of a Collector's Edition print does not transfer copyright ownership.

All copyrights and intellectual property rights remain the exclusive property of Shutter & Motion Photography LLC.

No reproduction, duplication, scanning, publishing, licensing, or commercial use is permitted without prior written authorization.

No Investment Guarantee

Collector's Edition prints are sold as collectible artwork. Shutter & Motion Photography LLC makes no representation, warranty, or guarantee regarding future appreciation, resale value, or investment performance.

Authenticity

Shutter & Motion Photography LLC maintains records of all Collector's Edition prints produced and sold. Authenticity may be verified through the accompanying Certificate of Authenticity and edition records.

Only Collector's Edition prints purchased directly from Shutter & Motion Photography LLC or an authorized representative shall be considered authentic.

Shutter & Motion Photography LLC reserves the right to maintain edition records and verify authenticity through certificates, signatures, edition numbering, and sales records.

Unauthorized reproductions, copies, scans, or imitations shall not be considered authentic Collector's Edition artwork.

Returns and Replacements

Due to the limited nature of Collector's Edition artwork, all sales are final.

Damaged shipments must be reported within one (1) days of delivery. Replacement prints may be provided if inventory remains available. If the edition has sold out, alternative remedies may be offered at the sole discretion of Shutter & Motion Photography LLC.

 

5.Notice to Commercial Entities

Businesses, corporations, advertisers, event promoters, media outlets, publishers, sponsors, marketing agencies, and other commercial organizations are responsible for obtaining written permission prior to using any photograph, artwork, or content owned by Shutter & Motion Photography LLC.

The use of copyrighted material for commercial gain, advertising, promotion, publication, merchandising, sponsorship, artificial intelligence training, or any revenue-generating activity without written authorization may result in legal action seeking damages, profits obtained through unauthorized use, attorney fees, court costs, and all other remedies available under applicable law.

Unauthorized Commercial Use

Any commercial, promotional, advertising, editorial, marketing, or revenue-generating use of photographs owned by Shutter & Motion Photography LLC without prior written authorization is strictly prohibited.

Unauthorized use of copyrighted images may constitute copyright infringement under United States law.

Shutter & Motion Photography LLC reserves the right to pursue all available legal remedies, including but not limited to:

• Immediate removal of the infringing content.

• Recovery of unpaid licensing fees.

• Recovery of actual damages and lost revenue.

• Recovery of profits derived from the unauthorized use.

• Recovery of attorney fees and court costs where permitted by law.

• Injunctive relief preventing further use of the copyrighted material.

Businesses, organizations, publishers, advertisers, sponsors, event promoters, and other commercial entities must obtain written permission and any required licensing before using, reproducing, displaying, distributing, or publishing any image owned by Shutter & Motion Photography LLC.

Unauthorized commercial use may result in legal action.

Commercial entities found using copyrighted images without authorization may be subject to licensing claims, copyright infringement claims, and legal action. The value of any claim may substantially exceed the standard licensing fee due to the unauthorized nature of the use and any resulting damages.

 

6. Jurisdiction Clause

These Terms and Policies shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising from the use of this website shall be subject to the jurisdiction of the courts located within Michigan.

 

7. Payment Disputes and Chargebacks

By placing an order through this website, the customer acknowledges and agrees that all information provided during the purchase process is accurate and that they are authorized to use the selected payment method.

Customers are encouraged to contact Shutter & Motion Photography LLC directly to resolve any concerns regarding orders, shipments, print quality, or billing issues before initiating a payment dispute or chargeback with their financial institution.

In the event a customer receives a product and subsequently initiates a chargeback, payment reversal, or payment dispute alleging non-delivery, unauthorized use, or other inaccurate claims, Shutter & Motion Photography LLC reserves the right to provide supporting documentation to the payment processor, financial institution, marketplace, or legal authority. Such documentation may include:

• Customer communications

• Signed delivery receipts when available

Customers who retain possession of delivered products while obtaining a payment reversal may be subject to collection efforts, recovery actions, civil claims, or other remedies permitted by law.

Shutter & Motion Photography LLC reserves the right to refuse future sales, services, licensing, or transactions to any customer who engages in fraudulent or abusive chargeback activity.
